The BIG Bathroom Shop Terms & Conditions

These terms and conditions do not affect your statutory rights. At the Big Bathroom Shop Limited we want you to enjoy a totally new experience in Bathroom, Bedroom and Kitchen shopping. We are dedicated to providing the highest level of customer service and transparency. Delivery times can vary between product types. You must be at least 18 years of age and be able to accept delivery within the UK to order goods through our website. The placement of an order indicates your acceptance of these terms and conditions. All major credit and debit cards are accepted with the exception of American Express. Once your credit/debit card details have been submitted we will treat this as an offer by you to purchase the goods subject to these terms and conditions. Please feel free to print a copy of our terms and conditions for future reference.

We reserve the right at any time prior to acceptance to refuse any order or part order, or to require further information to enable us to evaluate and/or process the order.

1. DESCRIPTION OF GOODS & PRICE

All images, descriptions and specifications on our site are for the sole purpose of giving an approximate description of the goods. All specifications given to the customer are approximate and intended as a guide only. The Company does not accept responsibility for any preparation work based upon any such specifications.

The price of the goods shall be the price given on the date your order is placed and will be confirmed on your invoice/order form. All prices include VAT at current rate but exclude delivery costs where applicable. Delivery charge will be payable as indicated at the time of placing your order.

2. CONDITIONS

2a. In these terms and conditions:
'goods' means the items purchased by you the customer which The BIG Bathroom Shop Limited is to supply in accordance with these terms and conditions.
'Supplier' means The BIG Bathroom Shop Limited, Units 1 – 4 York Towers, 383 York Road, Leeds, LS9 6TA.
'Website' means www.thebigbathroomshop.co.uk

3. ORDERING OF GOODS

3a. On completion of placing your order online, you will receive an email acknowledgement to the email address provided when placing the order. Please note that this does not mean that your order has been accepted by us. The contract between us is formed when the goods are despatched. We (The BIG Bathroom Shop LImited) reserve the right, at any time prior to acceptance, to refuse any order or any part of an order.

3b. We may refuse to accept an order if:

  • Where goods are not available, or have been withdrawn or discontinued.
  • Where we cannot obtain authorisation for your payment.
  • If there has been a pricing or product description error.
  • If you do not meet any eligibility criteria set out in our terms and conditions.

3b. If goods are ordered over a weekend, Bank Holiday or after 2.00pm the order date is taken as the next working day.

3c. If any goods are priced in error, The BIG Bathroom Shop will not be bound to honour incorrect prices.

4. CANCELLATION OF ORDER (prior to Delivery)

4a. To cancel your order please email: orders@thebigbathroomshop.co.uk.

4b. If the order has already been despatched from the warehouse, you will be unable to cancel your order. In these circumstances you will have to returns the goods yourself, as stated under the Returns Policy.

4c. Bespoke items may not be cancelled after ordering.

4d. Refunds will be issued as soon as possible, usually within 30 days

5. PRICING

5a. The price of the goods shall be the price given on the date your order is placed and will be confirmed on your invoice/order form. All prices include VAT at current rate but exclude delivery costs where applicable. Delivery charge will be payable as indicated at the time of placing your order.

5b. The prices offered on our website may not reflect the prices as in our stores. We reserve the right to offer special website prices to our online customers that will not be offered if the product is purchased in one of our stores.

6. DELIVERY OF GOODS

6a. The delivery of goods to you is deemed to be a separate contract for services, different from your contract to buy the goods.

6b. For goods which are shipped on a pallet, the goods will be delivered as close as possible to your front door. The delivery drivers are not insured to take their vehicles off the public highway. If your property is unreachable for any reason delivery will be made as near to your property as possible.

6c. The refusal of a delivery due to cancellation where goods have already been despatched from the warehouse or goods to be delivered on a pallet, will lead to the actual delivery costs and collection fees being charged.

6d. The delivery will be made by a single driver, so please ensure at least one able bodied person is available to assist the driver with the carrying.

6e. The driver is NOT insured to take the goods inside your property. So therefore if the goods ordered are of a heavy or bulky nature, it is strongly recommended that at least two able bodied persons are available to get the goods inside the property.

6f. Delivery dates (inc. Next Day deliveries) are approximate and no liability whatsoever is accepted in respect of late deliveries. Please do not arrange fitting of the items until they have been delivered and checked for discrepancies/damages. We will contact you "the customer" for an agreed delivery day, usually within 7 working days if no instructions given on the order form. Made to measure items, estimated delivery times 3 to 4 weeks. (Mason Smart Ranges).

7. DAMAGES & SHORTAGES

7a. When items arrive, you agree to open all boxes, thoroughly check the goods for damage and notify us via email to orders@thebigbathroomshop.co.uk if there is damage/shortage within a reasonable time period (upto 24 hours). If the packaging of the item appears damaged on delivery, please write 'damaged' on the delivery note. The drivers will not wait whilst you check the product.

7b. For items which are despatched using a pallet service you agree to check the goods for damage. Any products damaged in transit must be noted at the time of delivery and documented on the delivery note. We will not accept claims for products damaged in transit that were signed for as being in good condition. The delivery driver will wait for up to 10 minutes whilst you thoroughly check the items. If you have purchased a large number of items, it is advisable that you have another able bodied person to help in checking of the goods.

7c. If part of an order is damaged on delivery, accept all of the order but make a note on the delivery note which item(s) are damaged. Notify us within 24 hours and we will arrange collection of the damaged item(s) and delivery of the replacement item(s). Do not refuse delivery unless all items are damaged.

7d. If you appoint someone else to receive and sign for the goods on your behalf, you agree to advise them that the goods must be checked and you accept full responsibility for any damage or losses if they sign on your behalf.

7e. The BIG Bathroom Shop cannot consider any claims for damage or shortages 24 hours after delivery.

7f. From the time of receipted delivery of the goods. Any loss or damage to the goods shall be at your own risk.

7g. If a bespoke item arrives damaged, a replacement will be despatched once manufactured.

8. RETURNS POLICY - Non-Faulty Goods

8a. If you do not require a product when you receive it, you may cancel your order at any time until the end of the seventh working day after the day on which you receive your goods. Please note the goods to be returned must be in its original packaging ready for resale in good condition and unused. You must not write on any packaging as this will make the goods no longer resalable. Please affix a label addressed to The Big Bathroom Shop, 383 York Road, Units 1&2 York Towers, Leeds, LS9 6TA.

8b. Due to hygiene concerns some of our products cannot be returned, once opened.

9. RETURNS POLICY - Faulty Goods

This applies to goods which develop a fault after installation and not transit damage (please see section 7, for damaged goods in transit).

9a. All goods supplied by The BIG Bathroom Shop come with a 12 month manufacturers guarantee. When products are stated as having longer guarantees, these guarantees are covered by the manufacturer and not The BIG Bathroom Shop.

9b. In the event of faulty goods being returned at the expense of the customer, The BIG Bathroom Shop will refund reasonable postage costs.

9c. All returned faulty goods are tested by the manufacturer, and if the item is not faulty "BY MANUFACTURER" the product value will either be exchanged or refunded minus the cost of the testing process at the discretion of The BIG Bathroom Shop Limited.

9d. In most cases the manufacturers offer a service/breakdown engineer service who will visit your property to repair or replace the faulty item. If the fault is not causing any damage, please do not remove the installed item as this could void your guarantee. We find that it is quicker if you contact the manufacturer directly, to arrange a call from an engineer in the case of a product developing a fault.

9e. No refund or replacement will be given if the fault is deemed to be due to installation.

10. COLLECTION OF GOODS

10a. All goods can be collected from our warehouse, for directions please click here

10b. Please await email confirmation (or phone customer services) of pick-up time & date before visiting

10c. The BIG Bathroom shop Limited personnel are not insured to load customers vehicles, so make sure you have an able bodied person to help in the loading of your goods

10d. Please ensure that you thoroughly check all goods you have collected, as The BIG Bathroom Shop Limited cannot consider any claims for damage or shortages after the items have left our premises.

11. DELIVERY OF GOODS, SERVICE OF CONTRACT

11a. If you select the delivery option during the checkout stage, you are agreeing to enter into the delivery service contract.

11b. Once the items have been despatched from our warehouse the service contract cannot be cancelled.

11c. The refusal of a delivery, will lead to the actual delivery costs and collection fees being charged. Please note that the actual costs will be considerably higher than the standard price you were originally charged.

11d. Do not refuse delivery of a pallet unless all items are damaged , as you will be charged the actual delivery cost and collection fee.

11e. Delivery is to UK Mainland only.

12. WARRANTY / GUARANTEES

12a. This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the supplier, failure to follow the suppliers instructions, misuse, or any alteration or repair carried out without the suppliers approval.

12b. All guarantees eluded to on The BIG Bathroom Shop website are manufacturers guarantees and are passed on to you in good faith, however The BIG Bathroom Shop do not endorse them and they do not form any part of the contract between you and The Big Bathroom Shop. In the event that the manufacturer becomes insolvent the guarantee will be lost. The BIG Bathroom Shop will not bear the cost of communications, travel expenses of installation fees due to faulty goods.

12c. The BIG Bathroom Shop is a Trade Marked Brand and is registered at the UK Intellectual Property Office – No: 0978380001 and should not be confused with any other named company not registered with the IPO under any similar name.

13. WRITTEN COMMUNICATIONS

13a. By law we have to provide written information to you regarding your rights as a consumer. When using our site, you are accepting that we can send this information electronically to you (on the email you supplied when placing your order) and accept that these contracts and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.

14. EXTERNAL SITES

14a. The BIG Bathroom Shop Ltd is not responsible for the availability of, or content located on or through any external site linked to www.thebigbathroomshop.co.uk, nor for any transactions between you and such sites.
